I have experienced a sudden family bereavement and need to travel abroad over the next couple of days to attend the funeral. Due to the unexpected cost of last-minute flights and my regular ongoing expenses (such as rent) falling due at the same time, I am facing a temporary financial shortfall this month. Could you please let me know if a one-month temporary payment suspension or payment break is permitted under my Trust Deed for severe emergencies like this? Afternoon, I entered a trust deed with Carrington Dean in January 2024 with it being active the following month, this was also at a time I was due to remortgage. when doing my initial budget the mortgage payment was incorrectly quoted to me by Natwest (hadn't applied my repayment from previous deal during lockdown and holiday payments). Long story short I was out around £200 from what was listed ion my TD and what I was actually spending. Despite efforts to get this sorted I was told it was effectively too late and i'd need to wait until the next annual review. So 12 months on from what was probably that hardest financial year of my life, I tried contacting CD to arrange the annual review. Despite numerous efforts, emails, phone calls to overseas departments, this review wasn't done until November 2025 as it was impossible to get in contact with anyone who could speak English. Only after when i posted a google review did someone from Creditfix contact me asking first to remove my review, and then they could sort the review - sounds like blackmail? Anwyay, got the review done and payments were finally reduced to match the mortgage figure. Recently, there have been a few very unfortunate and unforseen events which ive had to pay/ help pay for (mother in laws funeral), that's now left me without the money i need to fix my car which then costs for for me to get to and back from work and i cant help feeling this would never be an issue if contacting them was simpler? Hi everyone, I am looking for some guidance from the experts/advisers on here before I contact my Trustee. I am currently 2.5 years (30 months) into a 4-year Scottish Protected Trust Deed and have maintained a completely flawless payment record from day one. Recently, I made an honest mistake regarding an employer wage advance, and I am anxious about how to handle it: What happened: My wife joined me from abroad, and I urgently needed to buy basic household essentials to set up our accommodation. I requested an advance on my wages from my employer, which is being repaid at £25 per week directly through payroll deduction. How I covered it: To ensure my regular income was not affected and my PTD contribution was never at risk, I took on 2 to 3 extra working hours every week specifically to pay back the £25 weekly deduction. The mistake: At the time, I genuinely thought taking an advance on my own earned pay was permissible without checking first. I didn't view it as taking out commercial credit. I have now realized that taking any form of advance/credit without prior Trustee approval is technically a breach of standard PTD terms. There was zero intent to hide anything or break the rules, and I want to self-disclose this to my Trustee to keep everything transparent. However, after 30 months of smooth payments, I am terrified of doing or saying the wrong thing. Before I send an email to my Trustee, I would really appreciate advice on the following: How severe is this in practice?
Hi I wonder if anyone can help me please? I entered into a protected trust deed in April 2019 and I was discharged in April 2023 I have a credit karma account and all my accounts were showing on this with the defaults and my bankruptcy was also showing but I noticed late last year everything had disappeared the only accounts now showing on my file are my current accounts and none of the previous accounts. I thought everything would be on my file for 6 years after my discharge or does it stay on from 6 years when I entered into the trust deed. Also when I’m applying for insurance do I have to declare that I was bankrupt or does that only apply until I’ve been discharged thanks for reading
Hi , So I am in a 6 years Trust Deed now in the final two years. Due to equity in my property. My question is Form 1b, it states that I need to pay £100 per month for 24 month, total amount is £2,400.. Question - If my salary goes up do I need to pay more per month? Do i still need to complete a annual review per year? Can I pay more than £100 per month? if I have extra one month £125, next month £110, so I can reduce the time? What word should i look for if it is not the case, that I still need to pay based on my income/expenditure? Readng through the Form 1b I dont see any wording that suggest to me that it is still based on my salary income removed link Thanks
Hi, I'm looking for some advice I have a year left in my trust deed which was added due to me owning my home (still has a mortgage). I was made unemployed in June due to caring commitments for my disabled son and also became a single mum to both kids at the same time. My whole income is now solely benefits but when I called my trust deed they said they could make me sell my house and my trust deed would fail if I couldn't keep payments. I have read in here that they are not supposed to take benefits as income what would happen in this situation? I feel like this was something that I was lied into taking and at a very vulnerable time in my life I feel like they are threatening me with making me and my kids homeless
Hi, I entered a protected trust deed in May 2025. I have had 2 CCJ's applied in July 2026. Both for debts that are included in the trust deed. I didn't know this could happen. Will these still be on my credit file a year longer than the rest? Sparrow
Ok update. Signed protected trust deed in 2023 54k have a house with loans on top of mortgage stuck in the northern rock disaster. Tried to change so many times unsuccessfully even before the debts. Was never advised my house was part of the deal. I was told 4/5 years maximum. In 2024 35k was written off. Contacted trustee company they said the write off made no difference, took it on the chin as we still had outstanding debt thought 2027 was the end date. This trust deed has never ever been annually reviewed. Last month I contacted them to clarify end date and query the write off. They replied saying 2032 end date pay 304 a month have never missed a payment! Stressed out my box. I made my reply very clear that I would like a review. Basically had a reply back saying more or less tough didn’t word like that but said there would be no review and the had interest in property and would run until 2032. I asked in the email for a review and slapped back with terms and conditions, which I never even knew about. My wife is has several disabilities and severe mental health issues along with 2 disabled children. Cost of living rising really struggling with this I only have 2 creditors left after the massive write off. I have asked yet again for a complaint procedure I await a response. This is insane now. Hello, I wonder if you may be able to help set my mind at ease. I entered into a PTD in 2021, the trustee discharged themselves and closed the PTD in 2024 due to my circumstances. This was filed with AiB and I was removed from the RoI 12 months later. I was involved in a car accident in 2025 and have subsequently accepted an offer of settlement in 2026. I have written confirmation from AiB that the PTD was closed in 2024 and written confirmation from the trustee dated 2024 that states "this can be used as evidence of the failure" they also mention their discharge from it. I sent these documents to my personal injury solicitor, however they remained adamant and have now sought to contact the old trustee given them a timeframe in which to indicate no claim or state a claim. The PI solicitor has already sent me emails with false/confused information, stating my vesting period is up until 2028 when my PTD was granted in 2021 and closed in 2024. I can forgive that as their area is PI not PTD. As the trustee discharged themselves and closed the PTD in 2024, refusing to discharge me from my debts (which is fine with me), to my knowledge, that trumps the four year vesting period. The car crash was after the closure date by 10 months and the settlement by 2 years. I am certain that they then cannot garrnish any of the PI settlement as the timeline dates after the PTD closure. It is my opinion that they cannot have a claim against it as it was not an asset present within the PTD timefr
I have just logged into my online portal and noted 2 letters of warning for arrears. I was of the belief I was up to date as I always check my bank. For this instance- the payment was pending and then I forgot about it. The payment this month did not come off so I went looking into why. Religiously payment has been pushed back due to lack of funds even tho there is money in my account and it usually comes off on the computers second attempt. It has been this way for well over a year. when I logged into today I read these letters saying payment wasn’t made and to get In touch. It also states they gave me options to repay which they didn’t as I didn’t know about it. I have not received a phone call, an email or had any letters through the mail box as I have changed address. I contacted them about change of address and they informed to get in touch once I received a letter with my name and new address on it which I have not yet had and it has been one month or so since the move. in the second letter the arrears quoted an amount of £0.00 I have missed payment after checking but it was Unkown to me, I have payed what is due and what was missed, what I want to know is why was these letters created, why didn’t I receive any other contact via telephone or email for something they appear to be taking so seriously. Is the amount quoted a mistake? Where do I stand with such errors, please help,
Hi, my DCO was set at zero at the start of my sequestration because my outgoings are too high. My 12 month is coming up in August so I will be discharged. My question is if I suddenly have a spare £100 a month 18 month after the initial bankruptcy is finished can a DCO be set up still after this period? There isn’t any reason I will suddenly have this surplus income at the moment but I feel like I would like to know how it works. I’ve found the whole process quite stressful. Many thanks
I was put in a trust deed in 2023 for a debt of 8,700 with income of 35,400 and no assets. I have since increased my income to 60,000 as I entered it quite young. I didn't know how much of it would be fees. I knew there would be some, but did not think it would be that much. I called whoever I could because I was panicked and felt like I was drowning. It provided a bit of relief at the start, but I didn't know how much it would affect my life. I read it would "negatively impact credit" but I didn't know just how much. It doesn't feel like I have "bad credit" it feels like I am not even allowed any credit, even a phone plan. We have a notice to quit from our landlord because he wants to move a family member in, though conveniently after we said about an underlying issue that needs repairing. We have tried to look for properties and get rejected constantly. We then went with private landlords to explain the situation, and they would smile and node and say they understand. We would offer to use a guarantor company like RentGuarantor, but still hear nothing just silent rejections. We can't go to social housing because I earn too much, I can't go to mid market because I earn too much. I can't make a final settlement because of their stupid fees making a debt of 8.700 balloon to almost 15k! If it were England I could make a reasonable final offer but that isn't a thing here anymore. We are at risk of homelessness, my job is remote and cant work in a hotel or b&b, we have cats... I'
